In the Spanish legal system, the patrimonial responsibility legal concept can be extracted particularly from the Eminent Domain Law, as a system of objective and direct liability, built outside the traditional notions of fault or neglect applied to an official or a causative agent. In this sense, the current law system acknowledges the private individuals’ right to compensation for damages caused to their rights and goods, provided that such damage is the result of the normal or abnormal activity of public services, except for cases of force majeure.
